  1. Scope, Contractual Partners, and Conclusion of Contract

These General Terms and Conditions (GTC) apply to all reservations and accommodation contracts concluded between Giessen Hotel & Coffeehouse and third parties (guests), as well as to all other services and deliveries provided by Giessen Hotel & Coffeehouse.

The contractual partners are Giessen Hotel & Coffeehouse and the guest. If a third party books one or more rooms for the guest, they are jointly and severally liable to the Giessen Hotel & Coffeehouse together with the guest for all obligations arising from the concluded contracts. In this case, both the guest and the third party are liable jointly.
The contract for the rental of rooms is concluded with the written confirmation of the hotel or, in the case of online bookings, with the booking confirmation received by the guest. Subletting or otherwise transferring the rented rooms to third parties, as well as their use for purposes other than accommodation, requires the prior written consent of the Giessen Hotel & Coffeehouse.

By concluding the contract, the contractual partner acquires the right to the usual use of the rented rooms as well as the facilities that are normally and without special conditions accessible to guests (e.g. lobby & lounge). Guests are aware that the staff of the Giessen Hotel & Coffeehouse is only available to a limited extent, and that the guest must exercise personal responsibility.
The scope of services under the contract is determined by the guest’s reservation.
Unused services (e.g. breakfast) will not be refunded.

  1. Reservations / Resale / Group Regulations

Reservations are made electronically via the Giessen Hotel & Coffeehouse’s online channels, via third parties/agents (e.g. online booking portals), in writing by email, or by telephone.
For a reservation, the guest must provide a valid credit card with at least 3 months’ validity at the time of booking. The Giessen Hotel & Coffeehouse has the right to verify the validity of the credit card and to carry out a pre-authorization. The payment and cancellation conditions communicated at the time of booking apply, which may vary depending on the rate.

Reservations for non-refundable rates, clearly indicated as such in the description or terms, cannot be canceled or rebooked free of charge.

By reserving a hotel room, an accommodation contract is concluded. This is binding for both parties. The GTC form an integral part of the contract. There is no entitlement to a specific room unless explicitly agreed. The guest receives a binding written reservation confirmation with a booking/reservation number from Giessen Hotel & Coffeehouse. Guests are reminded that reservation numbers received from third parties (e.g. portals like booking.com) are not identical to the reservation/booking numbers from Giessen Hotel & Coffeehouse.

If, despite a confirmed reservation, no room is available, the Giessen Hotel & Coffeehouse must inform the guest in good time and provide equivalent accommodation in a nearby hotel of comparable or higher category.
Any additional expenses for the replacement hotel are borne by the Giessen Hotel & Coffeehouse. If the guest rejects the replacement hotel, the hotel must immediately refund any payments already made.

The resale/rental and/or brokerage of reserved rooms is prohibited. Assignment or sale of claims against the Giessen Hotel & Coffeehouse is also not permitted. In such cases, the Giessen Hotel & Coffeehouse is entitled to cancel the booking. Use of the hotel room for purposes other than accommodation is expressly prohibited. The Giessen Hotel & Coffeehouse reserves the right to decline accommodation contracts with any guest at its sole discretion.

Reservations of more than 9 rooms are subject to the Giessen Hotel & Coffeehouse’s group regulations. For such bookings, a separate accommodation contract must be concluded, confirmed by the Giessen Hotel & Coffeehouse, which includes special conditions regarding cancellations and payment terms. The Giessen Hotel & Coffeehouse reserves the right to reject or cancel group reservations without such a contract.

  1. Cancellation / No-Show / Withdrawal

In the event of cancellations by the guest, the total amount of the stay will be retained. After expiry of the cancellation deadline, the guest’s credit card will automatically be charged the full accommodation amount plus any additional booked services. With the cancellation, the guest’s right to use the room expires.

In the event of a no-show, the full amount of the stay will in all cases be retained and the guest’s right to use the room lapses entirely. The Giessen Hotel & Coffeehouse reserves the right to cancel any reservation at any time. Resulting compensation claims are limited to the total accommodation price of the booked stay. The Giessen Hotel & Coffeehouse strongly recommends taking out travel cancellation insurance.

If the guest has been granted a free right of withdrawal within a specific period in writing, Giessen Hotel & Coffeehouse is likewise entitled to withdraw from the contract within that period if other guest requests exist for the reserved rooms even if the guest does not waive their right of withdrawal when asked by the Giessen Hotel & Coffeehouse.

Furthermore, Giessen Hotel & Coffeehouse is entitled to withdraw from the contract without notice, for example if:

  • force majeure or other circumstances not attributable to the Giessen Hotel & Coffeehouse make fulfillment of the contract impossible;
  • rooms were booked under misleading or false statements of material facts, e.g. regarding the person of the guest or the purpose;
  • the Giessen Hotel & Coffeehouse has justified reason to believe that the use of the hotel’s services could jeopardize smooth business operations, security, or the reputation of the establishment, without this being attributable to the control or organizational area of the Giessen Hotel & Coffeehouse;
  • the guest makes significantly disadvantageous use of the premises or, through inconsiderate, offensive, or grossly improper behavior, makes cohabitation intolerable for other guests, the owner/tenant, or third parties living in the hotel, or commits criminal acts against property, morality, or physical safety;
  • the guest is afflicted with a contagious illness or an illness extending beyond the period of stay, or otherwise requires care;
  • the stay is unlawful.

In the event of withdrawal by the  Giessen Hotel & Coffeehouse for the above reasons, the guest is not entitled to compensation.

  1. Check-In and Check-Out

Check-in is carried out via the designated self-check-in-terminal in the lobby or by mobile phone. After completing check-in, the guest personally codes their room card directly at the terminal. Upon departure, the room card must be deposited in the slot provided to the left of the terminal.
Reserved rooms are available to the guest from 3:00 p.m. on the day of arrival until 11:00 a.m. on the day of departure, unless otherwise agreed upon at the time of reservation. On the day of departure, the guest must vacate and return their room undamaged by no later than 11:00 a.m. If the guest fails to vacate the room by 11:00 a.m., they owe the Giessen Hotel & Coffeehouse a lump-sum compensation of 100% of the overnight price for one night. In addition, the Giessen Hotel & Coffeehouse reserves the right to have the room vacated by staff and to store all items brought in by the guest. For such stored items, the Giessen Hotel & Coffeehouse assumes no further liability beyond what is stated in these GTC.
Guests wishing to arrive earlier or check out later must book these additional services in advance.
If a room is occupied before 7:00 a.m., the previous night counts as the first overnight stay.

  1. Registration Form and Disclosure of Personal Data

The guest is obliged, within the framework of statutory requirements, to provide truthful personal data and registration-related information in advance via the electronic online registration portals or directly at the self-check-in terminal of the Giessen Hotel & Coffeehouse. Reservations without first and last name will not be accepted, and the Giessen Hotel & Coffeehouse reserves the right to cancel such bookings.

For booking, check-in and check-out processes, and digital guest services, the hotel cooperates with bsmart services AG, Industriestrasse 2, 9487 Gamprin-Bendern, Liechtenstein. Acting on behalf of the hotel, bsmart services AG provides services in the field of virtual reception, booking management, and guest communication. The processing of personal data is carried out in accordance with the applicable data protection regulations, in particular the EU GDPR and the Swiss Data Protection Act.

  1. Taxes, Fees, and Charges

The applicable prices are gross total prices and include all statutory taxes, fees, and charges except for visitor’s tax, which is shown separately. In the event of changes to tax rates, fees, and charges, as well as the introduction of new taxes, fees, and charges previously unknown to the parties, the Giessen Hotel & Coffeehouse reserves the right to adjust the prices accordingly. Accommodation prices are quoted per room, per night, per person.

  1. Prices & Means of Payment

All prices listed in price lists, on websites, or elsewhere are in Swiss Francs (CHF) per night and room including breakfast, service, statutory VAT, overnight tax, and internet access (Wi-Fi).

Valid means of payment for hotel stays are Mastercard and Visa. The Giessen Hotel & Coffeehouse does not have a staffed reception; therefore, cash payments are not possible. On the day of departure, the guest automatically receives the final invoice for accommodation by email.

  1. Use of Reserved Rooms / Children

For safety reasons, all room categories have a maximum occupancy corresponding to their size of 2 persons. This number may not be exceeded.
Infants/children aged 0–3.99 years may stay in the room free of charge upon request if they sleep in the parents’ bed. Children aged 4 and above are subject to a fee and must be properly registered. All children, regardless of age, must be registered at the time of booking with their year of birth.

For an additional charge of CHF 18.00 per night, a baby cot can be reserved with the room booking. Baby cots must be reserved by email at least 24 hours prior to arrival.

  1. Use of Public Areas

With the reservation of a room, the guest may use the designated public areas such as the lobby and lounge free of charge during their opening hours. The Giessen Hotel & Coffeehouse reserves the right to close public areas or the lounge without prior notice, including after 5:00 p.m. (e.g. for events). In the event of non-availability of a public area, the guest has no right to a partial or full refund of the accommodation price. Public areas such as the lounge are not considered part of the accommodation contract for the booked room.

  1. Liability of Giessen Hotel & Coffeehouse

The Giessen Hotel & Coffeehouse is liable for guests’ belongings in accordance with statutory provisions. Liability exists only if items have been handed over to authorized staff or brought to a designated place.
Liability for slight negligence is expressly excluded. Should the guest suffer damage or be dissatisfied with services, they must notify the Giessen Hotel & Coffeehouse immediately; otherwise, no claims can be made.

All claims against the Giessen Hotel & Coffeehouse expire six months after the guest’s departure, unless mandatory statutory provisions provide longer periods.
If the contractual partner is a business, liability for gross negligence is also excluded.

  1. Liability of the Guest

The guest must treat the hotel room with care. Children under 14 years must always be supervised by an adult during their stay. The guest is liable for damages and consequential damages caused by them. This includes, even in cases of slight negligence, excessive soiling, damage of any kind, and costs of a fire alarm. The guest is obliged to comply with safety regulations.

  1. Insurance

Insurance for items brought in is the sole responsibility of the guest. The Giessen Hotel & Coffeehuse may request proof of insurance even before confirming a reservation.

  1. Illness of the Guest

If a guest becomes ill or incapacitated, the Giessen Hotel & Coffeehoes may contact a doctor without request. Medical care is at the guest’s expense.

  1. Food and Beverages Brought In

The consumption of food and beverages brought in is prohibited in public areas. Breakfast may only be taken in the designated public areas. The preparation of food in guest rooms is prohibited. The use of kettles, mini ovens, toasters, immersion heaters, irons, and similar devices in rooms is strictly forbidden.

  1. Events

For events where food and drinks are served, the actual number of participants may not be more than 20% lower than the number specified in the event contract, regardless of the time of reduction. Otherwise, the difference up to the maximum reduction will be charged. The organizer must inform the Giessen Hotel & Coffeehouse of the final number of participants at least 5 working days before the event. If the number increases, the actual number of participants will be used for billing. Reductions after the final number is communicated will not be taken into account in billing.

  1. Non-Smoking Policy and Fire Protection

The Giessen Hotel & Coffeehouse is a completely non-smoking establishment. Smoking is therefore prohibited both in public areas and in guest rooms. In case of violation, the Giessen Hotel & Coffeehouse has the right to claim compensation, including loss of revenue. Smoking is permitted on balconies and in designated outdoor areas.

The following fire safety regulations must be observed throughout the building. Only the items and devices belonging to the room equipment may be used.
The use of kettles, ovens, toasters, immersion heaters, electric irons, and similar devices is prohibited.

Tampering with smoke detectors will incur a penalty fee of at least CHF 1,000.00 per room, plus any consequential costs.

If the fire brigade is called due to false or improper alarm activation, a fee of at least CHF 1,000.00 plus fire brigade costs will be charged to the responsible guest.

  1. Pets

Bringing pets requires the consent oft he Giessen Hotel & Coffeehouse. In principle, only dogs are welcome. The condition is that the dog is under the constant supervision of the guest, free of illness, and poses no danger to guests or staff. Dogs may accompany their owners at breakfast.

A fee of CHF 20.00 per night applies and requires the guest to bring their own dog basket or blanket. The Giessen Hotel & Coffeehouse has to be informed about the dog at least 24 hours prior to the arrival date. The owner is liable for any damage or heavy soiling to walls and infrastructure.

  1. House Rules

Giessen Hotel & Coffeehouse reserves the right to expel guests from the premises. This applies in particular if they do not follow staff instructions, make discriminatory remarks, harass, or endanger other guests. The 24-hour hotline is strictly for emergencies. Misuse will incur a fee. For the safety of all persons, public areas are under video surveillance where indicated.

  1. Parking

Guests have access to free parking spaces for cars, motorcycles, and bicycles/e-bikes. The hotel accepts no liability for parking damage, theft, or other damage to vehicles during the guest’s stay. This also applies to bicycles/e-bikes parked in the garage.

For fire safety reasons, vehicles parked unlawfully may be towed at the owner’s expense.

  1. Services

Guests have access in the lounge from 5:00 p.m. to various snacks, drinks, and hygiene items for a fee, payable the next morning at the coffee bar. Breakfast and selected beverages such as coffee and tea in the lounge after 5:00 p.m. are included in the room price.

  1. Internet

The Giessen Hotel & Coffeehouse provides free Wi-Fi internet access. The Giessen Hotel & Coffeehouse accepts no liability for internet malfunctions, damages caused by third parties, imported data of any kind (viruses, worms, trojans, etc.), or for links to and from other websites. The hotel has no control over the content or form of external websites.

The Giessen Hotel & Coffeehouse cannot guarantee error-free functioning of hardware and software and points out that this site may contain technical inaccuracies or typographical errors.

Under no circumstances is the Giessen Hotel & Coffeehouse liable to the guest or third parties for direct, indirect, special, or consequential damages arising from the use of this or linked websites. Liability for loss of profit, business interruption, or loss of programs or other data in the guest’s information systems is also excluded, even if the possibility of such damages has been pointed out.

  1. Data Protection

The Giessen Hotel & Coffeehouse is committed to maintaining the confidentiality of the guest’s personal data. The hotel provides the guest with content or services from other websites via links on this site. These sites are not subject to the hotel’s data protection regulations.

It is recommended that each site be reviewed individually to determine how data is protected. Guests provide the hotel with personal data for communication or reservation purposes. The Giessen Hotel & Coffeehouse reserves the right to use such data for marketing purposes. No guarantee is given for the confidentiality of emails or other electronic means of communication.

  1. Final Provisions

In case of contradictions between the accommodation contract and these GTC, the provisions of the accommodation contract take precedence. The accommodation contract and these GTC contain all agreements of the parties regarding the contractual subject matter. No oral side agreements exist. Amendments or supplements must be in writing. The Giessen Hotel & Coffeehouse is entitled to transfer all rights or claims arising from the accommodation contract to third parties.

The invalidity of one or more of the above provisions does not affect the validity of the remaining provisions. The invalid provision is to be replaced by a valid one that comes closest to the economic and legal intent of the parties.

All information (in particular prices, reservations, online calculations) is provided without guarantee. The hotel cannot guarantee that the information is always fully up to date. The Giessen Hotel & Coffeehouse reserves the right to change or update the information on this site at any time and without prior notice. This also applies to improvements and/or changes to products described on this site.

Changes or additions to the contract and reservation confirmation are, where possible, made in writing and published on the website www.giessen.li. Unilateral changes or additions are invalid. By making a reservation, the guest accepts the General Terms and Conditions.

This contract and any disputes arising therefrom are subject exclusively to Liechtenstein law.

Place of jurisdiction is the seat of the hotel or the competent court of the defendant.
